By downloading or using Pixel War (the "App"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
You must be at least 16 years old (or the digital-consent age in your country), or use the App with the consent of a parent/guardian.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial entertainment. The App is licensed, not sold.
Pixel War is a single public canvas that all players paint on together. Pixels you place ("User Content") are public and visible to everyone. You grant us a worldwide, royalty-free licence to host, display and distribute your User Content as part of the canvas and the service.
You must not: cheat or bypass the placement cooldown; use bots, scripts or automated tools; attack, overload or reverse-engineer the service; or interfere with other players' enjoyment.
The App is provided "as is". We do not guarantee uninterrupted availability and may change, suspend or discontinue features (including the canvas) at any time.
To the extent permitted by law, we are liable without limitation only for intent and gross negligence and under mandatory law (e.g. product liability, injury to life/body/health). For slight negligence we are liable only for breach of essential contractual obligations, limited to foreseeable, typical damage. Otherwise our liability is excluded.
You may stop using the App and delete your account at any time (see Account & Data Deletion). We may terminate or suspend access for breaches of these Terms.
These Terms are between you and the provider, not Apple. Apple has no obligation to provide maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty obligation; any claims regarding the App are directed to the provider. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You confirm you are not in a US-embargoed country or on a US prohibited-parties list, and you comply with the App Store Terms of Service.
We may update these Terms; continued use after changes constitutes acceptance. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, without prejudice to mandatory consumer protections of your country of residence.
Mit Download oder Nutzung von Pixel War (die „App") stimmst du diesen Bedingungen und unserer Datenschutzerklärung zu. Andernfalls nutze die App nicht.
Du musst mindestens 16 Jahre alt sein (bzw. das Einwilligungsalter deines Landes erreicht haben) oder die App mit Zustimmung der Erziehungsberechtigten nutzen.
Wir gewähren dir eine persönliche, nicht ausschließliche, nicht übertragbare, widerrufliche Lizenz zur privaten Nutzung. Die App wird lizenziert, nicht verkauft.
Pixel War ist eine einzige öffentliche Leinwand, die alle gemeinsam bemalen. Gesetzte Pixel („Nutzerinhalte") sind öffentlich und für alle sichtbar. Du räumst uns ein weltweites, unentgeltliches Recht ein, deine Nutzerinhalte als Teil der Leinwand und des Dienstes zu hosten, anzuzeigen und zu verbreiten.
Untersagt sind u. a.: Umgehen des Cooldowns; Bots/Skripte/Automatisierung; Angriffe, Überlastung oder Reverse-Engineering; Störung anderer Spieler.
Die App wird „wie besehen" bereitgestellt. Eine ununterbrochene Verfügbarkeit wird nicht garantiert; Funktionen (auch die Leinwand) können jederzeit geändert oder eingestellt werden.
Soweit gesetzlich zulässig haften wir unbeschränkt nur bei Vorsatz und grober Fahrlässigkeit sowie nach zwingendem Recht (z. B. Produkthaftung, Verletzung von Leben/Körper/Gesundheit). Bei leichter Fahrlässigkeit haften wir nur für die Verletzung wesentlicher Vertragspflichten, begrenzt auf den vorhersehbaren, typischen Schaden. Im Übrigen ist die Haftung ausgeschlossen.
Du kannst die Nutzung jederzeit beenden und dein Konto löschen (siehe Konto & Datenlöschung). Wir können den Zugang bei Verstößen sperren.
Diese Bedingungen bestehen zwischen dir und dem Anbieter, nicht mit Apple. Apple ist nicht zu Wartung/Support verpflichtet und übernimmt keine Gewährleistung; Ansprüche bezüglich der App richten sich an den Anbieter. Apple und seine Tochtergesellschaften sind begünstigte Dritte dieser Bedingungen.
Wir können diese Bedingungen aktualisieren; weitere Nutzung gilt als Zustimmung. Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts, unbeschadet zwingender Verbraucherschutzvorschriften deines Wohnsitzlandes.
